(California Consumer Privacy Act)

What is CCPA?
The California Consumer Privacy Act of 2018 (CCPA) gives customers more control over the personal data that businesses collect about them,
and the CCPA regulations outline how to put the law into effect. Consumers in California now have expanded privacy rights as a result of
this landmark legislation, which includes:

  • The right to know what personal information a company collects about them and how that information is used and shared
  • With limited exceptions, they have the right to have their personal information gathered from them deleted
  • They have the right to refuse to have their personal information sold
  • The right to be treated fairly when using their CCPA rights

Businesses must provide consumers with specific notices outlining their privacy policies. Many firms, including data brokers, are covered by the
CCPA.

The information in the Prospectss Privacy Policy is supplemented by this Privacy Statement for California Residents. This statement has been adopted by Prospectss to comply with the California Consumer Privacy Act of 2018 (the “CCPA”) and other California privacy laws, and it only applies to “consumers” as defined by the CCPA. When used in this statement, any terminology defined in the CCPA have the same
meaning.

Without providing prior notice, we will not collect additional categories of personal information or utilize the personal information we have acquired for materially different, irrelevant, or incompatible purposes. Personal Information Disclosure and Sale, as well as the Right to Opt-Out
Our consumers buy personal information that we collect for our database. Name, employer, job title, email address, phone number, office address, social media or professional profile link, and work or educational experience are all examples of information that could be found in this database regarding customers’ corporate identities. This information is sold to Prospectss customers for business-to-business sales, marketing, and recruiting reasons, and it is provided under licensing agreements that limit its usage to those objectives.

By visiting our Claim Page and filing a request to remove the consumer’s profile or delete the consumer’s data, a consumer can opt out of  Prospectss selling their personal information. A consumer or an authorized agent will be required to show that they have possession of an email inbox associated with the profile in issue in order to make a request. If such a person is unable to do so, we may be contacted about
alternate ways of establishing their identification or the authorisation of a third party to exercise a consumer’s rights on their behalf. (Edit per our rules) 

For the avoidance of any confusion, Prospectss’ disclosure and/or sale of personal information within the above-mentioned categories is limited
to business contact information associated to a consumer’s profile as an employee of its employer. Prospectss does not collect, distribute,  disclose, or sell sensitive personal information (such as Social Security numbers, passport numbers, medical, or financial information). Personal information about minors under the age of 16 is never sold. 

Rights to Request Deletion
Subject to certain limitations, a consumer has the right to request that Prospectss remove any of their personal information that we have
collected and retained. Unless an exception applies, we shall delete (and direct our service providers and/or customers to delete) a consumer’s
personal information from our records once we receive and confirm a genuine consumer request. 

We may refuse a consumer’s request for deletion if keeping the information is required by us, our service providers, or our customers to:

  • Complete the transaction for which the personal information was acquired, supply a good or service that a consumer requested,
    take steps reasonably expected in the context of our ongoing business relationship with that consumer, or otherwise fulfill our contract with that consumer
  • Detect security breaches, guard against malicious, misleading, fraudulent, or unlawful conduct, and prosecute those who are
    responsible
  • Debug items to find and fix faults that prevent them from performing their intended functions
  • Exercise your right to free speech, protect the right of another consumer to exercise their right to free expression, or exercise
    another legal right
  • Follow California’s Electronic Communications Privacy Act (California Penal Code 1546 et seq.)
  • If a consumer previously provided informed consent, engage in public or peer-reviewed scientific, historical, or statistical research
    in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion would likely render
    the research impossible or seriously impair the research’s achievement
  • Allow only internal uses that are reasonably matched with consumer expectations based on the relationship a consumer has
    with us
  • Comply with a legal requirement
  • Use the information for other internal and legal purposes that are
    compatible with the context in which a customer submitted it

Access, Data Portability, and Deletion Rights Exercising Access, Data Portability, and Deletion Rights
Please make a verifiable consumer request to us to exercise the above-mentioned access, data portability, and deletion rights by either:

Only a consumer or a person authorized by the consumer to act on the 
consumer’s behalf who is registered with the California Secretary of State may submit a verifiable consumer request pertaining to the consumer’s personal information. In addition, a consumer may make averifiable consumer request on behalf of their minor child.

Within a 12-month period, a customer may only make two verifiable consumer requests for access or data portability. The verifiable consumer request must include the following:

Provide enough information for Prospectss to fairly confirm that a consumer is an individual about whom we obtained personal data or an
authorized agent.
Describe a customer’s request with enough information for Prospectss to fully comprehend, assess, and reply to it.

If we can’t authenticate the consumer’s identity or authority to make the request and confirm the personal information belongs to that consumer, we won’t be able to react to their request or furnish them with personal information. A consumer does not need to register an account with us to make a verifiable consumer request. Personal information given in a verifiable consumer request will only be used to confirm the requestor’s identity or permission to make the request.

Timing and the format of responses
We make every effort to reply to a valid consumer request as soon as possible. We will send you a written response via mail or email. Anydisclosures we make will only cover the 12-month period prior to the receipt of a verifiable consumer request. If applicable, we will explain why we are unable to comply with a request in our response. We will use a format to deliver a consumer’s personal information that is easily usable and allows the consumer to transfer the information from one entity to another without difficulty for data portability requests.

Unless a customer’s verifiable consumer request is excessive, recurrent, or plainly baseless, we do not impose a fee to process or respond to it. If
we find that the request requires a fee, we will explain why we made that decision and offer a cost estimate to the consumer before we complete
the request.

We will not treat a customer unfairly if they exercise their CCPA rights

Changes to Our Privacy Statement
We reserve the right to make changes to this privacy policy at any time. If we make changes to this privacy statement, we will notify you by email or a notice on the homepage of our website.
